Participate in the "France from a Window" Instagram photo contest. #FranceFromAWindow #FenêtreSurMaFrance.
The main stages of the contest:
- From the 13th of November to the 11th of December 2018 : e-influencers share with their community "how to participate in the contest."
- From the 13th of November to 17th of December : Like the e-influencer's post and share your best photo of France through a window with the hashtags #FranceFromAWindow or #FenêtreSurMaFrance and #Francefr, identifying the e-influencer.
- From 19th of November to 17th of December 2018 : The e-influencers choose their favourite photo in their community.
- On 21st of December 2018: Atout-France chooses the winner of the contest among the photographs selected by the e-influencers.
- From the 13th of November to the 21st of December : the most beautiful photos are shared by the @Francefr account.
Section 1. CONTEST ORGANISATION
Atout France (hereinafter the "Organising Company"), an Economic Interest Group, with its head office located at 79/81 rue de Clichy - 75009 Paris, registered with the Paris Trade and Companies Register under number 340,709,211, represented by its General Manager, Mr. Christian MANTEI, is organising a free contest with no obligation to purchase called "#FenêtreSurMaFrance #FranceFromAWindow," the objective of which is to promote the image of France as a destination.
The contest is open from 13th of November to 21st of December 2018 (according to French connection dates and times) and shall be carried out on Instagram according to the terms and conditions specified in these rules.
This operation is not organised, managed or sponsored by Instagram, which, therefore, bears no responsibility with regard to the contest.
Section 2. TERMS OF CONTEST ANNOUNCEMENT
The contest shall be announced on the Facebook and Instagram pages of the Organising Company, www.france.fr, accessible at the following address for the United Kingdom: https://uk.france.fr/en.
In each of the countries mentioned above, an e-influencer selected by the Organising Company shall share the terms of participation in the contest with his/her community on the social network Instagram.
These Rules shall be accessible at all times at the following address: https://uk.france.fr/en/news/list/francefromawindow.
Section 3. TERMS OF PARTICIPATION
This contest is open to any natural person of legal age who has access to the Internet, an Instagram account and a valid e-mail address, with the exception of Atout France staff and their relatives, e-influencers and their relatives as well as all persons involved in the development of the contest.
The photographs submitted must necessarily be consistent with the theme of the contest by representing France through a window and complying with applicable legal provisions. They must not be contrary to public order or morality.
The mere fact of participating in this contest implies unconditional acceptance of these rules, without reservations.
SECTION 4. TERMS OF PARTICIPATION
This contest shall be carried out on the social network Instagram from the 11th of November 2018 to the 21st of December 2018 (according to French connection dates and times). This contest consists of the submission of a photograph representing France through a window.
To enter the contest, the participant must:
- "Like" the post of KimmConn (US), Autenticchica (NL), Debbynijs (BE), LittleMissNottingHill (UK), kommwirmachendaseinfach (DE);
- Post a photograph taken by him/her, representing France through a window on the social network Instagram on his/her Instagram account. The photograph must be posted as "public," with the hashtags #Francefrand #FranceFromAWindow or #FenêtreSurMaFrance;
- Tag the e-influencer: KimmConn (US), Autenticchica (NL), Debbynijs (BE), LittleMissNottingHill (UK), kommwirmachendaseinfach (DE);
Participants may post several photographs, if they wish.
SECTION 5. TERMS FOR ELECTING THE WINNER AND AWARDING THE PRIZE
5.1 The prize shall be granted to a single photograph in the contest.
Among all of the photographs posted by participants, each e-influencer representing a country in which the contest is organised shall select one photograph. As a result of this pre-selection stage, five photographs shall be preselected (one per country represented by an e-influencer).
A final jury composed of Atout France representatives (Head of Cross-Divisional Projects, Deputy Director of Communication, Head of Communication and Deputy Head of Communication) shall choose the winner from among the five photographs.
At each of the pre-selection and final selection stages, the photographs shall be chosen according to the following criteria:
- Creativity, originality and consistency with the theme 50%;
- Photographic quality 40%;
- Global impact (reach, likes, etc.) 10%.
No complaint may be made concerning the decisions of the e-influencers and the final jury, who shall decide in an independent manner and without appeal.
5.2 The Organising Company shall contact the winner by private message via Instagram no later than 7th of January 2019 to inform him/her of the award and to request the information required to make the arrangements for his/her stay. The information provided by the winner shall be forwarded to the Organising Company's service provider responsible for making the arrangements for the winner's stay in the Loire Valley.
Any winner who fails to provide an answer within ten (10) days of the delivery by the Organising Company of the private message informing him/her of the award shall be deemed to have forfeited the award.
SECTION 6. AWARD
The winner shall be awarded a stay in the Loire Valley for two people worth up to three thousand euros, excluding taxes (€3,000 excluding taxes). The award shall include the following:
- Depending on the country of departure, two round trip flights (to and from Paris) or two train tickets (to and from Tours). Transportation (by plane or train) shall be provided in economy class;
- Transportation to the private shuttle from the airport to Paris to the hotel in Tours or the Tours train station to the hotel in Tours;
- Return transportation by private shuttle from the hotel in Tours to the airport in Paris or from the hotel in Tours to the Tours train station;
- 3 nights for two people with breakfast included in a 2 or 3-star hotel in the centre of Tours chosen by the Organising Company;
- 3 dinners for two at a restaurant in the centre of Tours near to the hotel chosen by the Organising Company;
- Transportation by air-conditioned minibus with an accompanying driver, for excursions to discover the castles of Loire Valley;
- The following activities:
Two tickets to the Château de Chenonceau, the Château d'Amboise, the Château de Chambord, the Château de Cheverny and the Château d'Azay-le-Rideau;
Two tickets to the gardens of the Château de Villandry;
Guided tour of the city of Tours;
Visit to the museums of Tours.
The award does not include:
- Transportation from the winner's place of residence to the airport or train station on his/her departure or from the station or airport to the place of residence of the winner on his/her return;
- Personal expenses paid during the stay;
- Any services not expressly provided for in the description above.
The winner may use his/her prize from the 7th of January 2019 until 1 June 2019 inclusive. Accommodations shall be reserved forty-five (45) days before the desired date of departure. If the date of departure chosen by the winner is unavailable, he/she may choose other dates among those that remain available. If none of the proposed dates are suitable for him/her, he/she shall lose the prize, without being entitled to any refund, compensation or postponement of dates.
The prize is valid only once. It is non-refundable and cannot be transferred or exchanged in any way whatsoever, including for its cash value.
SECTION 7. VALIDITY OF PARTICIPATION
The Organising Company reserves the right to conduct any verification to ensure compliance with these rules. The participants authorise the Organising Company to carry out any necessary verification, in particular concerning their identity.
Any participation in the contest that does not meet the conditions established in these regulations or that involves falsification or takes place outside of the participation period shall be deemed invalid.
The Organising Company reserves the right to take legal action, by any means, against any attempt to misapply these rules.
The Organising Company reserves the right to exclude any person who fails to observe the provisions of these rules or who alters the procedure for participation in the contest. It reserves the right to take legal action against any person attempting to avoid or disrupt the proper course of the contest. If it is determined that the winner has violated the rules, he/she shall automatically be stripped of his/her prize.
The Organising Company may decide to cancel the contest if it appears that obvious fraud has been committed in any way and on any medium whatsoever, including by digital means in the context of participation in the contest.
SECTION 8. GUARANTEES OF PARTICIPANTS IN THE CONTEST
The participants hereby declare that they directly hold all necessary rights over the photographs that they post, as the photographers, namely all copyrights related to property worldwide, for their use for the benefit of the Organising Company.
As such, the participants declare that they are the sole holders of the rights to the photographs posted in the framework of the contest, and hereby guarantee to the Organising Company the use of the rights granted to it against any impediments, claims or exclusions.
Should the photographs posted online in the framework of the contest include subjects that may give rise to copyrights, personal image rights or property rights, the participant guarantees, in particular, that he/she has verified that the object or subject of the photograph is free of any rights, or guarantees that he/she has obtained the written consent of the holder of the related copyrights, personal image rights or property rights.
The participant agrees to comply with all applicable laws and regulations, including the prohibition of the dissemination of pornographic, paedophilic, violent or obscene content or content that is contrary to human dignity. The participant is solely responsible for the content of the photographs that he/she posts.
The Organising Company shall not be held liable for their illegality under applicable laws and regulations.
SECTION 9. REIMBURSEMENT OF PARTICIPATION EXPENSES
No financial compensation or expenses of any kind whatsoever may be claimed by the participants for their participation.
Connection costs paid by the participant to participate in the contest shall be refunded following a written request sent to the Organising Company's address, by a lump sum of fifteen cents, all taxes included (0.15 euros, all taxes included) for 5 minutes of connection with a limit of one refund request per participant (same name, same address, same e-mail) throughout the contest.
To obtain a refund, participants must send the information indicated below to the following address: Atout France - Jeu concours « FenêtresurmaFrance » - 79-81, Rue de Clichy - 75009 Paris
- their full contact details (surname, first name, postal address, e-mail address, telephone number);
- a copy of the first page of his/her Internet access contract, including his/her identity, the name of his Internet provider and the description of the package;
- a photocopy of the operator's detailed invoice indicating the date and time of the connection by underlining them;
- an RIB (Statement of Bank Account ID) or RIP (Statement of Postal Account ID).
The request for a refund of the connection costs paid for participating in the contest must be made within a period of up to one (1) month following the receipt of the telephone bill (as indicated by the Postmark). Only one refund per household shall be made (same name, same address, same e-mail).
No refund request sent by email or telephone shall be taken into account.
The cost of photocopies and postage for the refund request shall also be reimbursed at the participant's request.
Refunds of expenses shall be provided by bank transfer only within an average of eight (8) weeks following receipt of the written request.
Any requests for refunds that are illegible, crossed out or incomplete shall not be processed.
However, no refunds shall be provided for access obtained free of charge or on flat rate basis (by a cable, ADSL or Wi-Fi connection or dedicated line, etc.) insofar as the participant has not paid any specific fees or expenses as a result of his/her participation.
SECTION 10. USE OF PHOTOGRAPHS BY THE ORGANISING COMPANY
Some of the photographs posted by the contest participants may be reproduced and represented by the Organising Company through its Francefr account on the Instagram and Facebook social networks. The Organising Company shall previously contact the participants by private message via Instagram for their authorisation to the use of their Instagram account name and for the reproduction and representation of their photographs on France.fr networks for a period of six (6) months after the contest and for them to send the image to the email address that shall be provided to them.
SECTION 11.PERSONAL DATA
In the framework of the contest, Atout France processes participants' personal data. A detailed description of Atout France's commitments in the framework of this contest regarding the protection of personal data is provided below.
11.1. Personal Data Controller
The controller of such personal data is: Atout France, an economic interest group registered with the Paris Trade and Companies Register under No. 340 709 211, with its head office located at 79/81 rue de Clichy - 75009 Paris.
11.2. Data Protection Officer
Atout France has appointed a data protection officer, whose contact details are as follows:

11.3. Categories of Personal Data Processed
The personal data collected are as follows:
- Identifying data:
1) For the use by Atout France of photographs for communication purposes related to the contest: e.g. Instagram account name.
2) For the arrangements for the winner's accommodations: e.g. full name, date of birth, identity card or passport number, e-mail address.
3) For the management of your refund request: e.g. RIB.
11.4. Purposes of the Processing of Personal Data
The purposes of the processing of personal data are as follows:
- Communication related to the contest.
- Transfer of the winner's required data to the Atout France service provider for the organisation of the winner's stay.
11.5. Legal Basis of Processing
Processing for the purposes of communication in relation to the contest is based on the participant's consent, which shall be obtained prior to any use of personal data.
Processing for the purposes of the transferring all winner-related information to the service provider of Atout France for the arrangements to be made for the winner's accommodations is based on the winner's consent.
It shall be performed in accordance with the provisions of Law No. 78-17 of 6 January 1978 and EU Regulation 2016/679 of 27 April 2016 (GDPR) and other legal provisions in force.
11.6. Recipients of Personal Data
The recipients of personal data shall be:
The staff of Atout France, its offices and subsidiaries abroad, responsible for organising the contest, if applicable, the service providers or subcontractors of Atout France required to participate in the processing (only when necessary). If is hereby specified that, in this case, this shall be done in compliance with the regulations in effect applicable to subcontractors as defined by the GDPR;
Atout France's service provider responsible for arranging the winner's stay shall be a recipient of the winner's personal data as required for the arrangements. The service provider shall be responsible for the processing performed to organise the stay.
11.7. Transfer of Personal Data
The participant is hereby informed that the controller may, if appropriate, transfer his/her personal data to a third country or to an international organisation subject to an adequacy decision issued by the European Commission. It is hereby specified that, in the event of a transfer to a country or an international organisation not subject to an adequacy decision, this may only be done if the appropriate safeguards have been established and if the participants concerned have enforceable rights and effective remedies, under the conditions of applicable Regulations.
11.8. Duration of Preservation of Personal Data
The participants' personal data required for communication and promotion in relation to the contest shall be kept for a period of six (6) months after the contest end date, unless otherwise requested by the participant by an e-mail sent to the following address: email@example.com.
The personal data necessary to make arrangements for the winner's accommodations shall be destroyed within two (2) months after their transfer to Atout France's service provider and, in any event, after the proper collection of such data by the provider or once the winner has indicated that he/she would no longer like his/her personal data to be kept, by a request to the following address: firstname.lastname@example.org.
11.9. Participant Rights That May Be Exercised with the Controller
Participants are hereby informed of their right to request or indicate to the controller (as identified above), by a request sent to the address email@example.com:
- Access to their personal data and any available information available as to their source;
- The correction or deletion of such data;
- The limitation of the processing of their personal data;
- Their opposition to the processing of their personal data;
- Their opposition at any time to the processing of their personal data for prospecting purposes, including profiling;
- The portability of their personal data;
- The withdrawal, at any time, of their consent to the processing of their personal data (notwithstanding the lawfulness of the processing based on their consent performed prior to the withdrawal of such consent);
- Their post-mortem directives for French nationals.
Where necessary, it is hereby stated that, the exercise by the winner of his/her right to the deletion of his/her personal data or the exercise of his/her right to object to the processing of his/her personal data or the exercise of his/her right to the limitation of the processing of his/her personal data or his/her right to withdraw his/her consent to the processing of his/her personal data at any time (in accordance with the above provisions) may render it impossible to make arrangements for the winner's accommodations and, therefore, in such circumstances, as of the exercise by the winner of such rights, he/she may no longer claim his/her prize.
11.10. Filing of Complaints with the CNIL (National Commission for Information Technology and Civil Liberties)
The participant is hereby informed of his/her right to file a complaint with the supervisory authority, i.e. the National Commission for Information Technology and Civil Liberties (CNIL): 3 Place de Fontenoy - TSA 80715 - 75334 Paris 07.
The participant, a national of a Member State of the European Union, is also entitled to file a complaint with his/her national authority for the protection of personal data.
11.11. Possible Further Processing of Personal Data
If further processing of personal data is carried out for purposes other than those for which the personal data has been collected and as indicated above, the data controller (identified above) shall previously provide the participant concerned with information on such other purpose and any other relevant legal information required.
SECTION 12. LIABILITY
The Organising Company shall not be held liable, under any circumstances, if it is eventually required to cancel, shorten, extend, postpone or alter the terms of the contest.
No compensation may thus be claimed from the Organising Company.
The Organising Company shall not be held liable for any circumstance that is not attributable to it, especially in the event of the malfunction of telephone lines, site unavailability, Internet malfunctions, failures of the participant's computer, any other problem related to networks and means of communication (access providers, viruses, computer equipment that is defective or incompatible with hardware or software, etc.) or if information provided by the participant is incorrect or incomplete or is eventually destroyed for reasons not attributable to it. The Organising Company shall not be held liable in the event that one or more participants are unable to connect to the site due to any technical defect or any problem related in particular to network congestion.
In any case, the Organising Company shall not be held liable for the winner's physical inability to take the plane/train or to travel to France due to the invalidity of the documents required for him/her to travel (lack of visa or passport, expired passport, etc.).
SECTION 13. ACCEPTANCE OF THE RULES AND APPLICABLE LAW
Participation in this contest implies unconditional acceptance of these rules, without reservations.
These rules are issued in German, English, Dutch and French. In the event of a dispute, the French version shall prevail.
Any claim regarding the interpretation of the rules must be made in writing. No claim regarding the interpretation of these rules received by the Organising Company more than 15 days after the end of the contest shall be answered.
These rules are subject to French law.
Any difficulties in the interpretation of these rules and any disputes shall be settled by an out-of-court agreement between the Organising Company and the participant.
If the parties fail to reach an agreement, disputes shall be submitted to the competent courts of Paris (France).
